Terms of Use

The short version

Overberg Gold & Tech is a pawn shop in Sandbaai, Hermanus. We buy pre-owned gold, jewellery and tech, and we sell quality second-hand goods. These terms explain how buying, selling and pawn deals work when you deal with us — in store or through this website.

Buying from us (second-hand sales)

• All items are pre-owned unless clearly marked otherwise. Each item is tested in store before it goes on the shelf.
• Items are sold as-is, in the condition described. We point out flaws honestly — what you see is what you get.
• Prices are in South African Rand and fixed at the time of sale. Stock shown online moves fast — an item is only yours once it's paid for.
• Change-of-mind returns are not offered on second-hand goods. If an item is faulty in a way we didn't disclose, bring it back within 7 days and we'll make it right — repair, swap or refund at our discretion.
• Purchases made via Yaga are handled under Yaga's own buyer protection, courier and payment terms.

Selling to us

• You must be 18 or older and the legal owner of anything you sell or pawn. Valid South African ID is required for every transaction — no exceptions.
• We test and weigh gold in front of you and explain the price before anything is agreed.
• Once a sale is concluded and paid, ownership passes to Overberg Gold & Tech.
• We reserve the right to decline any item, and we report suspicious goods to the authorities as required by the Second-Hand Goods Act.

Pawn & lay-by terms

• Pawn loans: your item is held as security for an agreed loan period. Interest and fees are explained in writing before you sign.
• Redeem your item any time within the loan period by repaying the loan plus agreed fees.
• If a loan is not redeemed or extended by the due date, the item may be sold to recover the amount owed, as allowed by law.
• Lay-by: items are reserved once a deposit is paid and held until the full price is paid within the agreed period. Cancelled lay-bys may forfeit a reasonable handling fee.
• Full written terms are provided in store with every pawn or lay-by agreement — the written agreement always takes precedence.

Using this website

The stock list on this site is updated regularly but availability is not guaranteed until confirmed by us on WhatsApp, phone or in store. Website content, logos and images belong to Overberg Gold & Tech — please don't reuse them without asking.

Liability

We take care to describe and test every item, but to the extent allowed by law we are not liable for indirect losses arising from the use of goods sold. Nothing in these terms limits your rights under the Consumer Protection Act.
